Can my wife buy a house without my knowledge?

Dear George: I found a contract in my wife’s name to buy a house. She received an inheritance and was apparently looking for a new house without my knowledge. Can she buy a house by herself? Does her REALTOR® have an obligation to inform me of the contract?

Answer: Yes, your wife can purchase property without your knowing about it. She can use her own funds or joint funds. As far as the REALTOR®’s role, he has no obligation other than representing the best interests of his client: your wife. However, should your wife decide to sell, you would need to sign the closing documents or the title company would probably require you to sign a non-homestead affidavit.
