Do I have to disclose floor discoloration?

George Stephens, CRB, and Charles J. "Chuck" Jacobus, JD | Advice columnists

Dec. 11, 2012

Dear George: My REALTOR® has advised me to disclose that my wood floors have light and dark areas due to area rugs being down for years. I feel that this isn’t a defect, so I don’t have to disclose it. Who is right?

Answer: There is a rule of thumb with disclosures: If you have to ask, disclose it. It would be a good idea to disclose the floor discoloration and to move the rugs so the discoloration is evident to prospective buyers.
